Overview

This website, pelomiratu.com, is operated by Abajej UG (haftungsbeschränkt), Liegnitzer Straße 21, 60598 Frankfurt am Main, Germany, registered in the Commercial Register of the Amtsgericht Frankfurt am Main under HRB 144084 ("Pelomiratu", "we", "us", "our"). These Terms of Service apply to all use of our website and to all orders placed through our online shop. By visiting our website or placing an order, you agree to these Terms. If you do not agree, please do not use our website or services.

Section 1: Scope

These Terms apply to all contracts concluded between you and Pelomiratu via our online shop. We sell exclusively to customers with a delivery address in Germany. A consumer is any natural person who enters into a contract for purposes that are mainly outside their trade, business or profession.

Section 2: Conclusion of Contract

The products shown in our online shop are not a binding offer but an invitation to place an order. By clicking the order button at the end of the checkout process, you submit a binding offer to purchase the items in your shopping cart. You will then receive an automatic email confirming that we have received your order. This confirmation does not yet constitute acceptance of your offer. The contract is concluded when we confirm acceptance by a separate email or ship the goods to you.

Before submitting your order, you can review your entries and correct any errors at any time using the usual keyboard and mouse functions. The contract language is English.

Section 3: Prices and Payment

All prices shown in our shop are final prices and include the statutory German value added tax. Any shipping costs are shown separately before you complete your order. Payment can be made using the payment methods offered at checkout. Payment is due immediately when the order is placed unless another arrangement applies to the chosen payment method.

Section 4: Delivery

We deliver within Germany only. Delivery times and shipping options are described in our Shipping Policy. If an item you ordered is unexpectedly unavailable, we will inform you immediately and refund any payment already made without delay.

Section 5: Right of Withdrawal

As a consumer, you have a statutory right to withdraw from the contract within 14 days. Full details, including the model withdrawal form, can be found in our Returns and Refunds Policy.

Section 6: Retention of Title

The goods remain our property until full payment has been received.

Section 7: Warranty

The statutory warranty rights apply. If an item arrives damaged or defective, please contact us at info@pelomiratu.com with your order number, a short description and a photo of the issue so we can help you as quickly as possible.

Section 8: Liability

We are liable without limitation for damages resulting from injury to life, body or health, for intent and gross negligence, and under the German Product Liability Act. For slight negligence, we are only liable for breaches of essential contractual obligations, meaning obligations whose fulfilment makes proper performance of the contract possible in the first place and on which you may regularly rely. In such cases, our liability is limited to the foreseeable damage typical for this type of contract.

Section 9: Accuracy of Information

We take great care to keep the information on our website accurate and up to date. Occasionally, product descriptions, prices, images or availability may contain errors or omissions. We reserve the right to correct such errors and to update information at any time.

Section 10: Prohibited Use

You may not use our website for any unlawful purpose, to infringe the rights of others, to transmit harmful code, to collect personal data of other users, or to interfere with the security or functionality of the website.

Section 11: Intellectual Property

All content on this website, including texts, images, graphics and logos, is protected by copyright and belongs to Pelomiratu or its licensors. Any use, reproduction or distribution without our prior written consent is not permitted.

Section 12: Comments and Feedback

If you send us suggestions, ideas or other feedback, we may use them without restriction and without any obligation to compensate you. Your feedback must not violate the rights of third parties or contain unlawful, offensive or harmful content.

Section 13: Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law applies only insofar as it does not deprive you of the protection of mandatory consumer protection provisions.

Section 14: Severability

If any provision of these Terms is or becomes invalid, the validity of the remaining provisions shall not be affected.

Section 15: Changes to These Terms

We may update these Terms from time to time. The version published on our website at the time of your order applies to your order.
